4 Proposed Covenant Changes

Evergreen Meadows has 4 proposed covenant changes before our homeowners.   Below are explanations for each proposal  Please remember to submit your ballot by 12/31/2018

Below are two documents that can be downloaded and saved.  Also at the bottom of this web page are those two documents provided as attachements.

Voting Options

Ballots will be accepted beginning November 2, 2018 but no later than December 31, 2018.   Please submit your ballot via one of the 3 options.

  1.  On the ballot mailed in the annual dues letter, use the self-stamped envelope to return your ballot, updated form information and dues payment.

  2.  The EMHA mailing address is on the website's header.as shown below.

  1. Follow the directions below to upload your completed, scanned ballots to the web page shown below.

    1. Complete your ballot by ensuring your name and signature are on the form.
    2. Computer scan your completed ballot which creates an updated ballot document.
    3. Go to the EMHA web page - Evergreen Meadows Homeowners Association Voting Ballot – Fall 2018 Upload.  
      1. Fill out the form details which include your address, name and contact information.
      2. Click the bottom Add File tab under the Please upload your file here which will result in an Insert file form.
      3. This is where you attach your Updated ballot document from either your computer, disk or other computer peripheral where you document is stored.  Follow those instructions.
      4. Once the file is successfully uploaded, you will see the upload button on the Insert file form.   Press that button.

Should you want to verify that your file was successfully upload, please Email the board at board@emha.us, and we can confirm its receipt, or assist you with any other ballot delivery questions.

  A - Fire Department language change

Amendment A Synopsis:  Remove restriction on usage of Evergreen Fire Protection District's property on 7665 Malamute Drive on Evergreen Meadow's site 82.

Covenant Number 1. General Subject — Residential Use.  This covenant currently states that Evergreen Meadows' site 82 is to be used for firehouse purposes This proposal would remove the site 82 firehouse language.  This 2-acre property is deeded to the Evergreen Fire Department, and they'd like to sell the property as there are enough local fire facilities.  The sale proceeds are intended for repairs on the main Evergreen Fire Station located by the Evergreen Lake on Highway 73.

A - Fire Department language change
   B - Increase outbuildings allowance to two

Amendment B Synopsis - Increase allowance for accessory buildings from one to two.  

Covenant Number 6. Subject — Garages and Utility Buildings Section b) of the Declaration provides for one accessory building per property site.  This proposal would modify the language to increase covenant outbuilding allowance to two.

    C - Reduce the Covenant change vote requirement

 
Amendment C - Reduce the required number of Owners required to amend the Declaration from two-thirds (66.667%) to 55%.

Covenant Number 21. Subject — Modification of Covenants of the Declaration.  This proposed change would reduce the number of Owners(Declarants) written agreements required to change the covenants from two-thirds to 55%.

C - Reduce the Covenant change vote requirement
   D - Permit chicken raising

Covenant Number 10. Subject - Pets.  This  current declaration  states that no animals, livestock, or poultry of any kind shall be raised, bred or kept on any lot, except for household pets. 

This proposed change includes language that would allow raising chickens and ducks with restriction on usage, number of roosters plus require observance of the Jefferson County rules and permits.
